DMCA Copyright Policy

    How to report copyright infringement to Duogeeks, and how we respond.

    Sending a Takedown Notice

    It is our policy to respond to clear notices of alleged copyright infringement. If you believe that your intellectual property rights have been infringed upon by one of our users, we need you to send us a proper notification. All notices should comply with the notification requirements of the DMCA. You MUST provide the following information:

    • A statement identifying you as the owner of the copyrighted work, or as a person authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.
    • Identification of the copyrighted work you claim has been infringed.
    • Identification of the material you claim is infringing, with the exact link or location so we can find and remove it.
    • The web address of the page on which the material has been published.
    • Your contact information: full name, mailing address, telephone number and email address.
    • A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent or the law.
    • A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorised to act on behalf of the owner.
    • Your physical or electronic signature.

    Sending a Counter-Notice

    If your material was removed and you believe the removal was a mistake or a misidentification, you may send us a counter-notice at the same address.

    A valid counter-notice must include your physical or electronic signature; identification of the material removed and where it appeared before removal; a statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification; and your name, address and telephone number, together with a statement consenting to the jurisdiction of the federal court for the district in which you live, or for Orlando, Florida if you live outside the United States, and that you will accept service of process from the party who filed the original notice.

    If we receive a valid counter-notice we may restore the material in ten to fourteen business days, unless the original complainant notifies us that they have filed a court action.

    Repeat Infringers

    It is our policy, in appropriate circumstances, to disable and terminate the accounts of users who are repeat infringers.

    Misrepresentation

    You should be aware that, under the DMCA, claimants who make misrepresentations concerning copyright infringement may be liable for damages incurred as a result of the removal or blocking of the material, court costs, and attorney fees.

    A proper notification MUST contain the information above, or it may be IGNORED.
